Amtrak-riding drug dealer sentenced

A man who was arrested at the Amtrak station for bringing marijuana and hashish into Havre with the intent to distribute was sentenced to six years of probation.

Seth J. Mimm received a six-year deferred imposition of sentence for a felony count of criminal possession of dangerous drugs with intent to distribute and another six-year deferred imposition of sentence for a felony count of use or possession of property subject to criminal forfeiture, all pursuant to a plea deal.

District Judge Dan Boucher ordered the sentences to run at the same time.

Boucher ordered Mimm to pay $800 for assigned counsel and a $3,936 drug storage fine.

If Mimm abides by all the conditions of his release he can petition to have the felony charge struck from his record after the six years probation.

Mimm was riding with someone else on the Amtrak train in December 2015 when train employees reported seeing him smoke marijuana at an earlier stop in Whitefish.

Tri-Agency Safe Trails Task Force agents, along with Havre police officers, responded to the scene in Havre and found Mimm and the other man in their train car.

After law enforcement smelled marijuana in the train car, the men were interviewed separately. During the interviews, both men were claiming the same two pieces of luggage. Agents found two glass hash pipes in one of the bags and the men were arrested and search warrants were obtained.

The other bags were searched, and agents found 335 grams of marijuana, 114 grams of hash, $11,440 in cash — believed by authorities to be profits from illegally selling drugs — hash pipes, a Taurus .38 special revolver, and .38 special revolver ammunition.
