The two men who are accused of bashing a truck window with a bat and pointing a pistol at a group of people in February near TownHouse Inn of Havre are no longer in jail.
Hill County Attorney Gina Dahl objected, during a bail reduction hearing for Lacey The Boy and Arnold Sisneros Wednesday afternoon in state District Court, to a reduction of the men's bail. She said the charges against the men are too violent and reminded state District Court Judge Daniel Boucher that a young boy was injured to the point of needing medical attention as a result of their alleged actions. Nevertheless, Boucher released Sisneros on his own recognizance and reduced The Boy’s bail from $200,000 to $20,000.
The jail roster indicates The Boy has posted bail and is out.
Court minutes say Sisneros was to be fitted with a SCRAM bracelet, which monitors alcohol and location, before he was released. Sisneros’ public defender Kaydee Snipes Ruiz said he would stay with his wife and mother-in-law in Box Elder after released, both of whom agreed to supervise Sisneros.
Sisneros allegedly shattered the window of a truck with a baseball bat and caused pieces of glass to harm a 9-year-old boy inside the vehicle. Sisneros has pleaded not guilty to charges of assault with a weapon, criminal endangerment and criminal mischief.
Dahl, said in a press release, that The Boy allegedly “pointed the gun at the driver of another vehicle (the truck) and told him to get out.” The Justice Court probable cause affidavit says a video that was taken by bystanders at the scene shows The Boy pointing a gun toward two people while driving past them on U.S. Highway 2. This is part of the same altercation involving the shattered glass.
The Boy has pleaded not guilty to the charges of assault with a weapon, criminal endangerment, criminal possession of dangerous drugs and criminal possession of drug paraphernalia associated with the incident.
The court minutes say Randy Randolph, The Boy’s defender, said during Thursday’s hearing that The Boy would be staying with his fiancé in Havre and that he had “employment verification as a bus driver for Rocky Boy School.”
But Rocky Boy School Superintendent Voyd St. Pierre said Thursday, in a phone interview, that The Boy is neither employed with Rocky Boy Schools nor is he “being considered for any vacancy” at Rocky Boy schools.
Neither of the cases has been set for trial yet.
